The Board denied the Petitioner’s Request for Review of the Regional Director’s Decision and Direction of Election as it raised no substantial issues warranting review. A Board panel majority (Chairman McFerran and Member Ring) found that the present case was not materially distinguishable from the Board’s decision in Pennsylvania Virtual Charter School, 364 NLRB No. 87 (2016), and thus found that the Employer had failed to establish that the Regional Director had erred in finding the charter school not to be a political subdivision exempt from the Board’s jurisdiction.
