21st Century Cyber Charter School (04-RC-272006) West Chester, PA, August 18, 2021.  The Board denied the Petitioner’s Request for Review of the Regional Director’s Decision and Direction of Election as it raised no substantial issues warranting review.  A Board panel majority (Chairman McFerran and Member Ring) found that the present case was not materially distinguishable from the Board’s decision in Pennsylvania Virtual Charter School, 364 NLRB No. 87 (2016), and thus found that the Employer had failed to establish that the Regional Director had erred in finding the charter school not to be a political subdivision exempt from the Board’s jurisdiction.  Member Kaplan would have granted review.  Petitioner —21st Century Cyber Education Association, PSEA/NEA.  Chairman McFerran and Members Kaplan and Ring participated.

WellNow Urgent Care (03-RC-280300) Syracuse, NY, August 19, 2021.  The Board denied the Employer’s Request for Review of the Acting Regional Director’s order denying the Employer’s Motion to Dismiss the petition.  The Board also denied the Employer’s request for a stay of proceedings as moot.  Petitioner—1199SEIU United Healthcare Workers East.  Chairman McFerran and Members Kaplan and Ring participated.

Savage Services Corporation (21-RD-264617) Wilmington, CA, August 19, 2021.  The Board denied the Employer’s and Petitioner’s Requests for Review of the Regional Director’s Supplemental Decision Disposing of Objections and Certification of Representative as they raised no significant issues warranting review.  Petitioner—an individual.  Union—Wholesale Delivery Drivers, General Truck Drivers, Chauffeurs, Sales, Industrial and Allied Workers, Teamsters Local 848, International Brotherhood of Teamsters.  Chairman McFerran and Members Kaplan and Ring participated.

C Cases

Law Enforcement Officers Security Unions, a/w the Law Enforcement Officers Security & Police Benevolent Association (Paragon Systems, Inc.) (09-CB-268971) Herndon, VA, August 20, 2021.  No exceptions having been filed to the July 9, 2021 decision of Administrative Law Judge Arthur J. Amchan’s finding that the Respondent had not engaged in certain unfair labor practices, the Board adopted the judge’s findings and conclusions and dismissed the complaint.  Charge filed by an individual.
