Introduction

This information has been prepared to assist businesses that are interested in selling their products and services to the National Labor Relations Board (NLRB).  This information sheet describes procurement procedures and policies generally applicable to buying conducted by NLRB. This document explains in broad terms the types of items purchased, who procures them and where they are purchased. Information specifically directed to small, disadvantaged, service disabled veteran-owned small businesses, and women-owned businesses is also included.

Purchases are also made at many field offices. The purchases made by these offices, however, are generally limited to small dollar value, off-the-shelf items that are available locally. The names and locations of the field offices may be obtained here.

 

Section 2 - Doing Business with NLRB

The FAR establishes local NLRB procedures relating to the acquisition of supplies and services under the authority of Title 41 of the United States Code (U.S.C.) and other statutory authority. The NLRB’s Acquisitions Management Branch purchases goods and services on a centralized basis using a variety of procedures, governed by the Federal Acquisition Regulation (FAR). Our acquisition personnel focus on finding diversified vendors that offer the best value to help the agency meet its mission. Purchases below the micro-purchase threshold are typically executed using the Government Purchase Card.

Forecast of opportunities

The Business Opportunity Development Reform Act of 1988 (Public Law 100-656), among other things, amended the Small Business Act to emphasize acquisition planning and requires Federal departments and agencies to compile and publish forecasts of contract opportunities each Fiscal Year (FY). The forecast projections are intended to inform the public about the agency's contracting needs and opportunities and to assist small businesses in their business development activities.

The information is published for planning purposes only and is not an invitation for bids, a request for proposals, or a commitment by the NLRB to purchase products or services. Each acquisition is based on the best information available at the time of publication and may be revised or canceled.

Small business

Small business entities considering doing business with NLRB may obtain assistance from the U.S. Small Business Administration. In addition to acquisition assistance programs, the SBA has an array of business, financial, and management assistant programs for small businesses, including those that are disadvantaged or owned by women and service-disabled veterans.

Section 3 - Guidance

Procurement integrity

The NLRB, like most federal agencies, purchases many products and services from the private sector. The expenditure of public funds requires the highest degree of public trust and an exceptional standard of conduct. To preserve the integrity of the Federal procurement process and assure fair treatment of offerors, and contractors, laws govern the procurement process, and the way federal and contractor personnel conduct business with each other. Specifically, Section 27 of the Office of Federal Procurement Policy Act (41 U.S.C. §§ 2101-07), commonly referred to as the Procurement Integrity Act, governs certain activities by persons involved in the procurement process. The FAR, at Section 3.104, sets forth regulations implementing the provisions of the Procurement Integrity Act.

Freedom of Information Act

The NLRB Freedom of Information Act (FOIA) Branch handles records and information pertaining to the FOIA and the Privacy Act.
