Mohawk Flooring and Janitorial Service, Inc. and Maurice Barnwell(11-CA-022379; 359 NLRB No. 21) Davie County, NC, November 14, 2012.
According to the uncontroverted allegations in the motion for default judgment, the respondents failed to comply with the terms of the stipulation and waiver with respect to the timely payment of backpay in scheduled installments. Consequently, due to the non-compliance provisions of the stipulation and waiver, the Board found that all allegations in the compliance specification were true and granted the Acting General Counsel’s motion for default judgment.
