Maywood SNF Operations LLC d/b/a Atlas Healthcare at Maywood  (22-CA-290363; 372 NLRB No. 152)  Maywood, NJ, October 13, 2023.

The Board granted the General Counsel’s Motion for Default Judgment based on the Respondent’s failure to file a timely answer to the complaint.  The Board found that the Respondent failed to show good cause why the Board should not find all allegations in the complaint to be true and rejected the Respondent’s untimely answer.  Accordingly, the Board found that the Respondent violated Section 8(a)(1) by discharging an employee for concertedly complaining to the Respondent and on social media about the shortage of clean linens and towels, and other terms and conditions of employment.

Charge filed by 1199 SEIU, United Healthcare Workers East a/w Service Employees International Union.  Chairman McFerran and Members Kaplan and Prouty participated.
