Rolling Hills Zoo Foundation  (14-RC-300414)  Salinas, KS, October 5, 2022.  The Board denied the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election  as it raised no substantial issues warranting review.  The Board applied its decision in Aspirus Keweenaw, 370 NLRB No. 45 (2020) regarding the direction of mail ballots during the COVID pandemic, noting that its revision of the Aspirus framework set out in Starbucks Corp., 371 NLRB No. 154 (2022) does not apply retroactively to cases pending at the time of its issuance, such as this one.  Petitioner—Service Employees International Union, Local 513.  Members Kaplan, Wilcox, and Prouty participated.

MJB Specialty, LLC, Blockchains, Inc., and/or Jeffrey Berns, Sole Proprietor, Joint Employers  (19-CA-266693)  Sparks, NV, October 4, 2022.  No exceptions having been filed to the August 22, 2022 decision of Administrative Law Judge Andrew S. Gollin’s finding that the Respondent had not engaged in certain unfair labor practices, the Board adopted the judge’s findings and conclusions and dismissed the complaint.  Charge filed by an individual.
