Unpublished Board Decisions in Representation and Unfair Labor Practice Cases

R Cases

Balfour Beatty Communities, LLC (28-RC-084408) El Paso, TX, October 12, 2012.  Having no exceptions filed to the hearing officer’s report, the Board adopted the hearing officer’s findings and recommendations, and found that a certification of results of election should be issued.  Petitioner – International Union of Operating Engineers, AFL-CIO, Local 953.

The Finley Hospital (33-RD-000899) Dubuque, IA, October 12, 2012.  Order affirming the Regional Director’s decision to hold petition in abeyance.  Member Hayes dissented: found the Regional Director abused his discretion under that policy by holding this petition in abeyance awaiting resolution of unfair labor practice charges pending before the Board.  Petitioner – an individual.  Chairman Pearce and Members Hayes and Block participated.

C Cases

Calumet River Fleeting, Inc. (13-CA-079800) Whiting, IN, October 10, 2012.  Order denying the employer’s petition to revoke subpoena duces tecum.  Charge filed by International Union of Operating Engineers, Local 150.  Chairman Pearce and Members Hayes and Griffin participated.

Security Walls, LLC and Allied Barton Security Services (13-CA-076699) Batavia, IL, October 11, 2012.  Order denying the respondent’s motion for summary judgment.  Charge filed by International Union, Security Police and Fire Professionals of America.  Chairman Pearce and Members Hayes and Griffin participated.

NAACP Houston Branch (16-CA-027783) Houston, TX, October 12, 2012.  Order having no statement of exception filed, the Board adopted the findings and conclusions of the administrative law judge’s decision and ordered the respondent to take the recommended action.  Charge filed by an individual.
