International Longshore and Warehouse Union  (19-CD-269624 and 19-CD-269637)  Seattle, WA, September 13, 2023.  The Board denied the Charging Party’s Motion for Reconsideration of the Board’s Decision and Order, reported at 372 NLRB No. 66 (2023).  The Board found that the Charging Party had not identified any material error or demonstrated extraordinary circumstances warranting reconsideration. Charges filed by SSA Terminals, LLC and the International Association of Machinists and Aerospace Workers, District Lodge 160, Local Lodge 289.  Chairman McFerran and Members Kaplan and Prouty participated.

New Haven Ecology Project, Inc., d/b/a Common Ground  (01-CA-294819)  New Haven, CT, September 15, 2023.  The Board denied the Respondent’s Motion for Partial Summary Judgment as the Respondent failed to establish that there are no genuine issues of material fact warranting a hearing and that it is entitled to judgment as a matter of law.  The Board’s denial was without prejudice to the Respondent’s right to raise its defense under Section 10(b) of the Act before the Administrative Law Judge and before the Board on any exceptions that may be filed to the judge’s decision, if appropriate.  Charge filed by UAW Local 2110.  Chairman McFerran and Members Kaplan and Prouty participated.
