Summary of NLRB Decisions for Week of September 19-23, 2011

Summarized Board Decisions

Praxair Distribution, Inc. (28-CA-22806; 357 NLRB No. 91) Phoenix, AZ, September 21, 2011.

The Board adopted the Administrative Law Judge’s dismissal of the allegation that the Respondent violated Section 8(a)(1) by threatening employees for requesting to be jointly interviewed.  The Board noted that there was no evidence that the employees were threatened for having made the requests.  The Board also adopted the judge’s dismissal of the allegation that the Respondent violated Section 8(a)(1) by discharging an employee, noting that the Acting General Counsel failed to establish that animus toward the employee’s protected activity was a motivating factor in the decision to discharge him.  Finally, the Board adopted the judge’s finding that statements of the Respondent’s manager to the spouse of one of the employee constituted various threats in violation of Section 8(a)(1).  The Board noted that the statements were no less coercive when made to the spouse of an employee and the fact that the spouse initiated the discussion does not make it less likely that the statement was not relayed to the employee.  Member Hayes dissented, questioning whether the “spousal conduit” inference applied where the non-employee spouse initiated the specific conversation in question, and essentially provoked the employer representative into an irritated and spontaneous outburst.

Daycon Products Company, Inc. (5-CA-35687, et al.; 357 NLRB No. 92) Upper Marlboro, MD, September 21, 2011.

The Board adopted the Administrative Law Judge’s findings that the Respondent violated the Act by unilaterally implementing its last contract offer after prematurely declaring impasse, and that the subsequent strike by employees was an unfair labor practice strike; Respondent’s refusal to reinstate unfair labor practice strikers, who had offered to return to work unconditionally; and Respondent’s subcontracting bargaining-unit work without providing notice to or bargaining with the union.

Charges filed by Drivers, Chauffeurs and Helpers Local 639, affiliated International Brotherhood of Teamsters.  Administrative Law Judge Joel P. Biblowitz issued his decision February 15, 2011.  Chairman Pearce and Members Becker and Hayes participated.
