Region 31 Secures Injunction in District Court

At the request of the National Labor Relations Board, U.S. District Court Judge Christina A. Snyder has issued a temporary injunction under Section 10(j) of the National Labor Relations Act against Hospital of Barstow, Inc., d/b/a Barstow Community Hospital (“the Respondent”). Judge Snyder ordered that Respondent cease and desist from, inter alia, refusing to bargain in good faith with California Nurses Association/National Nurses Organizing Committee (CNA/NNOC/NNU) (“the Union”) as the exclusive collective-bargaining representative of employees in the Unit; changing the terms and conditions of employment of the Unit or announcing such changes without prior notice to the Union or without affording the Union an opportunity to bargain with Respondent with respect to these changes; and refusing to provide the Union with information it requested that is relevant and necessary to its role as the exclusive collective-bargaining representative of the Unit.
Under Judge Snyder’s order, Respondent must bargain in good faith with the Union concerning wages, hours and terms and conditions of employment, and put in writing and sign any agreement reached; furnish the Union with certain requested information; bargain with the Union regarding wage increases; rescind certain changes to employees’ terms and conditions of employment; and rescind discipline issued to nurses. Judge Snyder also ordered a notice reading. The temporary injunction granted Wednesday, August 29, 2016, by Judge Snyder in the Central District of California will remain in effect until the underlying case is fully resolved by the National Labor Relations Board. The Court found that the Region’s argument was likely to succeed, that irreparable harm would likely occur if the injunction was not granted, and that the balance of hardships and public interest weighed in favor of granting the injunction.
