Voting Unit (Unit A):Included: All full-time and regular part-time* LPNs employed by the Employer at its 813 Fay Road, Syracuse, NY location.** Excluded: All office clerical employees, homecare agency LPNs, clinical coordinator LPNs, guards, professional employees and supervisors as defined in the Act, and all other employees. *The parties agree for the purpose of eligibility in this election, regular part-time employees are employees that worked an average of four (4) or more hours a week during the 13 weeks immediately preceding the eligibility date for the election. **There is a dispute as to whether the five (5) LPN assistant unit managers and two (2) LPN supervisors should be included in the unit. The parties have reserved the right to challenge the eligibility of these employees and to resolve their status in a post-election proceeding, if necessary.
