Voting Unit (Unit A):Included: All full-time and regular part-time production and maintenance employees, laboratory technicians, and warehouse employees employed by Employer at its 5115 Highway 47, Dalbo, Minnesota facility; Excluded: All other employees, professional employees, managers, and guards and supervisors as defined by the Act, as amended. Others permitted to vote: The parties have agreed that the Maintenance Lead, Master Operation Technician, Production Lead, and Warehouse/Cooler Lead classifications may vote in the election, but their ballots will be challenged since their eligibility has not been resolved. No decision has been made regarding whether these classifications are included in, or excluded from, the bargaining unit. The Employer’s position is that these classifications are supervisory within the meaning of Section 2(11) of the Act. The eligibility or inclusion of these classifications will be resolved, if necessary, following the election.
