Voting Unit (Unit A):Group “A”: All full-time, regular part-time Assessment Counselors and GED Teachers employed by the Employer at its 100-140 Lincoln Highway & Hackensack Avenue, Kearny, New Jersey facility, but excluding all Office Clerical employees, Secretaries, Leads, Unit Counselors, Operational Counselors, Program Counselors, Food Service Workers, Program Activities employees and Maintenance employees, and other non-professional employees, guards and supervisors as defined in the Act, and all other employees. Group “B”: All full-time and regular part-time Unit Counselors, Operational Counselors, Program Counselors, Food Service Workers, Program Activities employees, and Maintenance employees employed by the Employer at its 100-140 Lincoln Highway & Hackensack Avenue, Kearny, Newark, New Jersey facility, but excluding, all Office Clerical employees, Secretaries, Leads, Assessment Counselors, GED Teachers, and other professional employees, guards and supervisors as defined in the Act, and all other employees. 1) If a majority of the employees in voting group “A” vote to be included in a unit with the employees in voting group “B”, the following employees will constitute a unit appropriate for the purpose of collective bargaining within the meaning of Section 9(b) of the Act: All full-time and regular part-time Assessment Counselors and GED Teachers, Unit Counselors, Operational Counselors, Program Counselors, Food Service Workers, Program Activities employees, and Maintenance employees employed by the Employer at its 100-140 Lincoln Highway & Hackensack Avenue, Kearny, Newark, New Jersey facility, but excluding all Office Clerical employees, Secretaries, Leads, guards and supervisors as defined in the Act, and all other employees. 2) If a majority of the employees in voting group “A” do not vote for inclusion in a unit with the employees in group “B”, the following two groups of employees will constitute separate units appropriate for the purposes of collective bargaining within the meaning of Section 9(b) of the Act: Unit “A”: All full-time, regular part-time Assessment Counselors and GED Teachers employed by the Employer at its 100-140 Lincoln Highway & Hackensack Avenue, Kearny, Newark, New Jersey facility, but excluding All Office Clerical employees, Secretaries, Leads, Unit Counselors, Operational Counselors, Program Counselors, Food Service Workers, Program Activities employees, and Maintenance employees, and other non-professional employees, guards and supervisors as defined in the Act, and all other employees.
