Voting Unit (Unit A):UNIT AND ELIGIBLE VOTERS. The following unit is appropriate for the purposes of collective bargaining within the meaning of Section 9(b) of the Act: There will be two voting groups in the election. VOTING GROUP A (PROFESSIONAL EMPLOYEES): Included: All full-time and regular part-time head teachers employed by the Employer at its facility located at 1175 Gates Avenue, Brooklyn, NY. Excluded: All family services coordinators, nonprofessional employees, assistant teachers, teachers' aides, food handlers, administrative assistants, confidential employees, maintenance employees, guards and supervisors as defined by the Act. VOTING GROUP B (NON-PROFESSIONAL EMPLOYEES): Included: All full-time and regular part-time assistant teachers, teachers' aides, food handlers, and maintenance employees employed by the Employer at its facility located at 1175 Gates Avenue, Brooklyn, NY. The employees in Voting Group A (Professional Employees) will be asked two questions on their ballots: 1. Do you wish to be included in the same unit as nonprofessional employees of Lutheran Social Services of Metropolitan New York for the purposes of collective bargaining? The choices on the ballot will be "Yes" or "No". 2. Do you wish to be represented for purposes of collective bargaining by COMMUNITY AND SOCIAL AGENCY EMPLOYEES UNION, DISTRICT COUNCIL 1707, AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES, AFL-CIO? The choices on the ballot will be "Yes" or "No". The employees in Voting Group 8 (Nonprofessional Employees) will be asked on their ballots, "Do you wish to be represented for purposes of collective-bargaining by COMMUNITY AND SOCIAL AGENCY EMPLOYEES UNION, DISTRICT COUNCIL 1707, AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES, AFL-CIO?" The choices on the ballot will be "Yes" or "No". If a majority of the professional employees in Voting Group A vote "Yes" to the first question, indicating their desire to be included in the same unit as non-professional employees, the group will be so included. The votes of the professional employees on the second question will then be counted with the votes of the nonprofessional employees in Voting Group 8 (Nonprofessional Employees) to determine whether or not Community and Social Agency Employees Union, District Council 1707, American Federation of State, County and Municipal Employees, AFL­ CIO, will represent the entire unit. If on the other hand, a majority of the professional employees in Voting Group A do not vote for inclusion, their votes on the second question will be separately counted to determine whether they will be represented by Community and Social Agency Employees Union, District Council 1707, American Federation of State, County and Municipal Employees, AFL-CIO, in a separate professional unit.
