University of Southern California  (31-RC-356388)  Los Angeles, CA, December 30, 2024.  The Board denied the Employer’s Request for Review of the Regional Director’s Order Rescheduling Hearing as it raised no substantial issues warranting review.  Petitioner—United Faculty, UAW.  Chair Wilcox and Members Kaplan and Prouty participated.

United States Postal Service  (15-CA-313872 and 15-CA-332520)  Westwego, LA, December 30, 2024. The Board denied the Respondent’s Motion for Partial Summary Judgment or to partially dismiss the complaint. The Board found that the Respondent had not demonstrated that there are no genuine issues of material fact warranting a hearing, that the complaint fails to state a claim upon which relief can be granted, or that the Respondent is entitled to judgment as a matter of law. Charges filed by an individual. Chair Wilcox and Members Kaplan and Prouty participated.

Con-Vey, LLC  (19-CA-335514, et al.)  Roseburg, OR, December 31, 2024.  The Board denied the Respondent’s Request for Review – construed as a Request for Special Permission to Appeal – of the Regional Director’s amendment to the complaint.  The Board found that the Respondent’s request was not properly before the Board.  The General Counsel has the prosecutorial discretion to amend a complaint at any time before the hearing, and her exercise of that discretion is not subject to Board or court review.  Charges filed by United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO, CLC.  Chair Wilcox and Members Kaplan and Prouty participated.

Blue Fox Heating and Cooling LLC  (25-CA-297685)  West Lafayette, IN, December 31, 2024.  The Board granted the General Counsel’s Request for Special Permission to Appeal the Administrative Law Judge’s approval of a non-Board settlement agreement.  On the merits, it denied the appeal.  The Board found that the judge did not err in approving the non-Board settlement because, on balance, it satisfied the standards set forth in Independent Stave Co., 287 NLRB 740, 743 (1987).  Charge filed by Sheet Metal Workers, Air, Rail, and Transportation Workers Local Union No. 20 a/w International Association of Sheet Metal, Air, Rail and Transportation Workers.  Chair Wilcox and Members Kaplan and Prouty participated.

Lucid USA, Inc.  (28-CA-313086 and 28-CA-322749)  Casa Grande, AZ, December 31, 2024. In this case alleging independent Section 8(a)(1) allegations, the Board approved a formal settlement stipulation between the Respondent, the Charging Party, and the General Counsel, and specified actions the Respondent must take to comply with the Act.  Charges filed by International Union, United Automobile, Aerospace and Agricultural Implement Workers of America.  Chair Wilcox and Members Kaplan and Prouty participated.
