Summarized Board Decisions

Mid-South Industrial, Inc.  (15-CA-326800; 374 NLRB No. 19)  Stanton, TN, January 27, 2025.  Errata to January 27, 2025 decision, January 28, 2025.  Errata   Amended Decision.

The Board granted the General Counsel’s Motion for Default Judgment based on the Respondent’s noncompliance with the provisions of the parties’ bilateral informal settlement agreement.  The case alleges Section 8(a)(5) and (1) violations.  The remedy orders the Respondent to comply with the unmet terms of the settlement agreement.

Charge filed by International Union of Operating Engineers Local 369.  Chairman Kaplan and Members Prouty and Wilcox participated.

The Boeing Company  (19-CA-272489; 374 NLRB No. 20)  Renton, WA, January 27, 2025. 

The Board, reversing the Administrative Law Judge, found that the Respondent did not violate Section 8(a)(3) and (1) by laying off seven instructor pilots and subcontracting their work.  The Board found that the Respondent established that it would have taken the same actions in the absence of the employees’ protected conduct of voting not to decertify their Union.

Charge filed by Society of Professional Engineering Employees in Aerospace, a/w International Federation of Professional and Technical Engineers, Local 2001. Administrative Law Judge Gerald M. Etchingham issued his decision on March 22, 2024.  Chairman Kaplan and Members Prouty and Wilcox participated.

Tri-State Rigging LLC  (10-CA-344807; 374 NLRB No. 21)  Clarksville, TN, January 27, 2025.

The Board granted the General Counsel’s Motion for Default Judgment based on the Respondent’s failure to file an answer to the complaint.  The Board found that the Respondent violated Section 8(a)(1) by discharging an employee for engaging in protected concerted activity. 

Charge filed by an individual.  Chairman Kaplan and Members Prouty and Wilcox participated.
