Essentia Health  (18-RC-330714)  Duluth, MN, January 7, 2025.  The Board denied the Employer’s Request for Review of the Regional Director’s Order Rescheduling Hearing and Order Denying the Employer’s Motion to Bifurcate the Hearing as it raised no substantial issues warranting review. The Employer’s Request for Review of the Regional Director’s Decision and Direction of Election remains pending. Petitioner—Minnesota Nursing Association.  Chair Wilcox and Members Kaplan and Prouty.

USC Care Medical Group, Inc. (USC Student Health Department)  (31-RC-320083)  Los Angeles, CA, January 7, 2025.   The Board denied the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election as it raised no substantial issues warranting review.  Petitioner—National Union of Healthcare Workers.  Chair Wilcox and Members Kaplan and Prouty participated.

MX Technologies, Inc.  (27-RC-319208)  Lehi, UT, January 7, 2025.  The Board denied the Employer’s Request for Review of the Regional Director’s Decision and Direction of Election as it raised no substantial issues warranting review.  In denying review, the Board found that the Employer failed to meet its burden under cessation-of-operations principles to establish that the alleged elimination of the petitioned-for unit was both imminent and definite.  In addition, the Board rejected the Employer’s contention that, by acknowledging after the election that three members of the unit had subsequently taken non-unit jobs, the Petitioner somehow conceded that the petitioned-for unit no longer existed.  Petitioner—International Brotherhood of Teamsters, Local 222.  Chair Wilcox and Members Kaplan and Prouty participated.
