Summarized Board Decisions

Starbucks Corporation  (21-CA-295845 and 21-CA-312405; 374 NLRB No. 23)  Los Angeles, CA, March 27, 2025.

In a previous decision (reported at 373 NLRB No. 115 (2024)), the Board severed and retained allegations that the Respondent violated Section 8(a)(5) and (1) by failing to provide the Union with prior notice and an opportunity to bargain over its decision to discipline an employee.  Having considered the matter, the Board adopted the Administrative Law Judge’s dismissal of this allegation.

Charges filed by Workers United.  Administrative Law judge Jeffrey D. Wedekind issued his decision on February 22, 2024.  Chairman Kaplan and Members Prouty and Wilcox participated.

Pacific Bell Telephone Company d/b/a AT&T California  (20-CA-314296 and 20-CA-318265; 374 NLRB No. 24)  Sacramento, CA, March 28, 2025.

The Board adopted the Administrative Law Judge’s conclusion that the Respondent violated Section 8(a)(5) and (1) by unreasonably delaying its response to grievance-related information requests from the Union’s December 2022 request. The Board found it unnecessary to address the issue of whether the Respondent also violated Section 8(a)(5) and (1) by unreasonably delaying its response to the Union’s January 2023 request for information because doing so would not affect the remedy.

Charges filed by Communications Workers of America, District 9, Local 9421.  Administrative Law Judge Robert A. Ringler issued his decision on February 16, 2024.  Chairman Kaplan and Members Prouty and Wilcox participated.

Freeman Expositions LLC  (20-CA-316968, et al.)  San Francisco, CA, March 24, 2025.  The Board denied the Respondent’s Motion to Dismiss the complaint as moot based on the March 7, 2025 Order Consolidating Cases. Douglas Food Stores, Inc., d/b/a Douglas Equipment  (10-CA-308342)  Bluefield, WV, March 24, 2025.  The Board denied the Respondent’s Motion for Summary Judgment, finding that the Respondent had not demonstrated that it is entitled to judgment as a matter of law.  Charge filed by an individual.  Chairman Kaplan and Members Prouty and Wilcox participated.

Valladares Landscaping Artists, LLC  (15-CA-306672 and 15-CA-306769)  Houma, LA, March 27, 2025.  No exceptions having been filed to the February 18, 2025 decision of Administrative Law Judge Robert A. Giannasi’s finding that the Respondent had engaged in certain unfair labor practices, the Board adopted the judge’s findings and conclusions, and ordered the Respondent to take the action set forth in the judge’s recommended Order.  Charges filed by individuals.

Bar at 66 Greenpoint, LLC, d/b/a Nighthorse  (29-CA-319202)  Brooklyn, NY, March 27, 2025.  No exceptions having been filed to the August 7, 2024 decision of Administrative Law Judge Lauren Esposito’s finding that the Respondent had engaged in certain unfair labor practices, the Board adopted the judge’s findings and conclusions, and ordered the Respondent to take the action set forth in the judge’s recommended Order.  Charge filed by an individual.
