Region 22 Issues a Complaint and Notice of Hearing Against Garda CL Atlantic, Inc.

Region 22 Director J. Michael Lightner issued a Complaint and Notice of Hearing against Garda CL Atlantic, Inc. on May 29, 2013.  The Employer has an office and place of business in Fairfield, New Jersey and is engaged in nationwide cash handling services.  The Complaint alleges the Employer violated Sections 8(a)(1) and (3) of the National Labor Relations Act by:  surveillance of employees engaged in union activities; threatening employees regarding employees' union activities; soliciting employee complaints and grievances, and promising employees increased benefits and improved terms and conditions of employment if they did not select the Union; informing employees that it would be futile for them to select the Union as their bargaining representative; soliciting employee complaints and grievances, and promising employees improved terms and conditions of employment if employees would instruct the Labor Board to withdraw the representation petition and give the Employer six months to make improvements; threatening employees with more strict enforcement of work rules, and; suspending employees and discharging employees in retaliation for the employee's union activities.   The original charge in this matter was filed by United Federation of Special Police & Security Officers, Inc.   A hearing before an Administrative Law Judge is scheduled to take place in the Regional office on July 1, 2013.
