Region 22 Issues an Amended Complaint and Notice of Hearing Against Spiniello Companies

Region 22 Director J. Michael Lightner issued an Amended Complaint and Notice of Hearing on July 25, 2013 against Spiniello Companies.  Spiniello Companies is located in Newfoundland, New Jersey and is engaged in the business of constructing and rehabilitating underground water and sewer systems.  Since at least 2006, a bargaining unit of Spiniello employees engaged in mechanical repair and rebuilding of construction equipment, welding and machine shop operations has been represented by Local 825, International Union of Operating Engineers.  The Amended Complaint alleges that Spiniello violated Section 8(a)(5) of the National Labor Relations Act by failing to make required contributions to the Union's welfare, annuity and political action funds without first bargaining with the Union to a good faith impasse.  The Amended Complaint also alleges that Spiniello enrolled unit employees in a new health insurance plan, reduced employees' annual vacation benefits, and ceased providing employees paid sick and personal days, also without first bargaining with the Union to a good faith impasse.  A hearing in this matter before an Administrative Law Judge is scheduled to take place on September 24, 2013 in the Region 22 office.
