Region 25-Indianapolis Secures Settlement Requiring Hall Aluminum Products, Inc. Pay $200,000 in Backpay and Benefits

On August 19, 2024, Region 25-Indianapolis signed off on an agreement settling a complaint against Hall Aluminum Products, Inc., located in Fort Wayne, Indiana and Kiowa, Colorado, based on three unfair labor practice charges filed by the International Union of Painters and Allied Trades (the Union).

The Regional Director of Region 25 issued a complaint against Hall Aluminum in May 2024 alleging Hall Aluminum violated the National Labor Relations Act (“Act”) when it announced it would withdraw its recognition of the Union as the exclusive collective-bargaining representative of its unit employees, sponsored and participated in the circulation of a decertification petition against the Union, and encouraged its employees to sign the petition. The complaint further alleged that the Employer maintained and enforced overly broad work rules that interfered with, restrained, and coerced employees from exercising their rights under the Act.

Under the terms of the settlement agreement, Hall Aluminum will make employees whole for the losses they suffered as a result of its unlawful withdrawal of recognition from the union—including paying $51,773 in backpay and interest to 25 employees and $148,944 to the Union’s Health and Welfare fund on behalf of 74 employees, which represents 100 percent of what was owed. Hall Aluminum must also cease its refusal to recognize the union and bargain with the union upon request, rescind unlawful rules and unlawful unilateral changes upon request from the union, cease urging, encouraging, and soliciting employees to file a decertification petition, and post, email, and read aloud a notice to all employees who work in the state of Indiana and Colorado, advising employees of their rights and Hall Aluminum’s obligations under the Act.

Nachand. “Workers have the right to take action without fear of retaliation, and these remedies serve to effectuate the National Labor Relations Act.”
