Region 31-Los Angeles Wins Board Decision Ordering The Daily Grill to Bargain in Good Faith on a Schedule with Progress Reports and Compensate Union and Employees for Bargaining Expenses

Los Angeles, California – On December 16, 2022, the Board issued a Decision and Order against Grill Concepts Services, Inc. d/b/a The Daily Grill. Members Ring, Wilcox, and Prouty affirmed Administrative Law Judge Dickie Montemayor’s determination that The Daily Grill violated the National Labor Relations Act by failing and refusing to bargain in good faith UNITE HERE Local 11, (the Union) which represents the workers.

In finding that The Daily Grill engaged in certain unfair labor practices, the Board’s order requires it to begin bargaining within 15 days of the Union’s request, meet with the Union at reasonable times and bargain in good faith with the Union. Such bargaining sessions shall be held for a minimum of 24 hours per month, for at least 6 hours per bargaining session, or in the alternative, on another schedule to which the Union agrees. Additionally, The Daily Grill must submit written bargaining progress reports every 30 days to the compliance officer for Region 31, with a copy to the Union.

The Daily Grill must also: compensate the Union for all bargaining expenses it incurred, including any lost wages the Union paid to employee bargaining committee members for bargaining conducted during working hours; make whole any affected employee negotiators for any earnings lost while attending bargaining sessions; post a Notice in English and Spanish for 60 days; and conduct a Notice reading.

“The National Labor Relations Act grants employees the right to bargain collectively through representatives of their own choosing. The duty to bargain in good faith is a core principle of the Act, one that is particularly important during negotiations for a first contract,” said Region 31 Regional Director Mori Rubin. “I commend Region 31 staff for their diligent work and commitment on this case, which I know will continue as we pursue full compliance with the Board’s order.”
