Region 31-Los Angeles Wins Injunction in District Court Ordering RadNet to Bargain with the Union and its Rabbi, to Submit Bargaining Progress Reports, and to Conduct a Notice Reading

Los Angeles, California — On June 1, 2022, U.S. District Judge Stanley Blumenfeld, Jr., of the Central District of California granted Region 31’s petition for Section 10(j) injunctive relief against RadNet Management, Inc.(“RadNet”).
In granting the injunction, Judge Blumenfeld found that, for six months, RadNet failed to respond to most of the Union’s proposals, that its negotiator abruptly ended bargaining sessions and engaged in inappropriate behavior, and that it refused to provide the Union with information. The Judge also found that RadNet refused to bargain because the Union included a rabbi as one of its negotiators. The Judge determined that, “an injunction would serve to prevent [RadNet] from continuing to engage in the allegedly unfair labor practices,” noting that the employer did not argue that it would suffer a hardship and that “the risk of harm is generally ‘minimal’ because ‘[t]he company is not compelled to do anything except bargain in good faith.’ Scott, 241 F.3d at 667.”
Judge Blumenfeld’s order requires that RadNet meet and bargain in good faith and at reasonable times with the Union, and, if an agreement is reached, act in good faith to produce a signed agreement. The Judge’s order also requires RadNet to submit written bargaining progress reports every 30 days to the Regional Director of Region 31. In addition, the Order requires that RadNet post copies of the Court’s order at its facility, granting the Region access to monitor compliance with the posting requirement and that it hold one or more mandatory employee meetings at which the Order will be read to the bargaining unit employees by a responsible employer official in the presence of a Board Agent or by a Board Agent in the presence of a responsible RadNet official.
“The National Labor Relations Act grants employees the right to bargain collectively through representatives of their own choosing. The duty to bargain in good faith is a core principle of the Act, one that is particularly important during negotiations for a first contract. RadNet’s compliance with the Court’s Order by bargaining in good faith will afford employees the opportunity to achieve the benefits of a collective bargaining agreement,” said Region 31 Regional Director Mori Rubin. “I commend Region 31 staff for their diligent work investigating the cases, litigating the matter before an Administrative Law Judge, and in obtaining the injunction.”
