Voting Unit (Unit A):Voting Group "A" Included: All full-time, part-time and per diem professional employees employed by the Employer at its facility located at 12601 Garden Grove Boulevard, Garden Grove, California. Excluded: All other employees, managers, supervisors, confidential employees, guards, physicians, residents, central business office employees (whether Facility based or not) who are solely engaged in qualifying or collection activities, employees of outside registries and other agencies supplying labor to the Employer and already represented employees. In addition, eligible to vote are those part time and per diem employees who worked in the unit an average of at least 4 hours per week during the 13-week period ending May 7, 2011, and who have not been terminated for cause or have not quit voluntarily prior to the completion of the last shift for which they were employed. Voting Group "B" Included: All full-time, part-time and per diem service and maintenance, technical, skilled maintenance and business office clerical employees employed by the Employer at its facility located at 12601 Garden Grove Boulevard, Garden Grove, California. Excluded: All other employees, managers, supervisors, confidential employees, guards, physicians, residents, central business office employees (whether Facility based or not) who are solely engaged in qualifying or collection activities, employees of outside registries and other agencies supplying labor to the Employer and already represented employees. In addition, eligible to vote are those part time and per diem employees who worked in the unit an average of at least 4 hours per week during the 13-week period ending May 7, 2011, and who have not been terminated for cause or have not quit voluntarily prior to the completion of the last shift for which they were employed. The employees in the professional group "A" will be asked two questions on their ballot: 1. Do you wish to be included with nonprofessional employees in a single unit for the purposes of collective bargaining? To which the choice of answers shall be "Yes" or "No." 2. Do you wish to be represented for the purposes of collective bargaining by SEIU-UHW (UNITED HEALTHCARE WORKERS-WEST), NEITHER, OR NUHW (NATIONAL UNION OF HEALTHCARE WORKERS). To which the choice of answers shall be "SEIU-UHW (UNITED HEALTHCARE WORKERS-WEST)" or "Neither", or "NUHW (NATIONAL UNION OF HEALTHCARE WORKERS)." If a majority of the professional employees in Voting Group "A" vote "yes" to the first question, indicating their wish to be included in a unit with nonprofessional employees, they will be so included. Their votes on the second question will then be counted together with votes of the nonprofessional employees. If the professional employees in Voting Group "A" vote against inclusion, they will not be included with nonprofessional employees. Their votes on the second question will then be separately counted to determine whether or not they wish to be represented by SEIU-UHW (UNITED HEALTHCARE WORKERS-WEST), NEITHER, OR NUHW (NATIONAL UNION OF HEALTHCARE WORKERS). The employees in the non-professional Voting Group "B" will be polled to determine whether or not they wish to be represented by SEIU-UHW (UNITED HEALTHCARE WORKERS-WEST), NEITHER, or NUHW (NATIONAL UNION OF HEALTHCARE WORKERS).
